Terms of Service

In plain terms. Alphie acts on your instructions, including on systems and accounts you connect to it. You stay responsible for what you ask it to do. It is an early-stage product built on AI models that make mistakes — check its work before relying on it for anything consequential.
1. Agreement
These Terms of Service ("Terms") are a contract between you and BIG NEWS LLC, a Delaware limited liability company ("we", "us"), governing your use of Alphie — the web application at app.04bot.com, the Alphie desktop client, and the website at 04bot.com (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy Policy is incorporated into these Terms by reference.
2. Eligibility and your account
- You must be at least 13 years old (16 in the European Economic Area and the United Kingdom) and legally able to enter into this agreement.
- You are responsible for your account credentials and for everything done through your account. Notify us promptly at [email protected] if you believe your account has been compromised.
- Provide accurate registration information and keep it current.
- One person per account. Do not share your account with others.
3. What the Service does — and what that means for you
Alphie is an AI assistant that stores context about you and takes actions on your behalf. Those actions can include running commands on devices you connect, reading and writing files, sending messages and email, and calling third-party services with credentials you have supplied.
You direct the assistant, and you remain responsible for the consequences of what you direct it to do. Actions taken through connected devices and accounts are real actions with real effects — including deleting data, sending communications, and incurring charges on third-party services. Review what you authorize, especially for irreversible operations.
4. Acceptable use
You agree not to use the Service to:
- Break the law, infringe intellectual property or privacy rights, or facilitate others in doing so.
- Access any system, account or data you are not authorized to access.
- Generate or distribute malware, spam, phishing, or content that sexually exploits minors.
- Harass, threaten, defame or impersonate any person.
- Attempt to defeat rate limits, quotas or security controls, or to extract our prompts, models or source code other than as permitted by any applicable open-source licence.
- Resell or provide the Service to third parties as your own product without our written agreement.
- Store credentials or data you are not authorized to hold, or use the Service in a way that violates the terms of a third-party service you connect to it.
We may suspend or terminate accounts that violate this section, and we may report unlawful activity to the authorities.
5. Your content
You own your content. Messages, files, documents and knowledge bases you create or upload remain yours. You grant us a limited, non-exclusive licence to host, store, transmit and process that content solely to operate the Service for you — including transmitting it to the AI model providers that generate responses. We do not use your content to train AI models. This licence ends when you delete the content or your account, subject to the backup retention described in the Privacy Policy.
You are responsible for having the right to upload and process the content you give us.
6. AI output — no warranty of accuracy
Alphie's responses are generated by AI models. They can be wrong, outdated, incomplete, or confidently mistaken, and identical requests can produce different answers. Do not rely on Alphie as a substitute for professional legal, medical, financial, or safety advice. Verify anything consequential before acting on it. You are solely responsible for decisions made and actions taken on the basis of the Service's output.
Output may not be unique; similar output may be generated for other users. To the extent you have rights in output generated for you, we do not claim ownership of it.
7. Third-party services
When you connect a third-party service — Google Drive, an email account, a code host, or any other — your use of that service remains governed by that provider's own terms and privacy policy. We are not responsible for third-party services, their availability, or their handling of your data. You must have the right to grant Alphie the access you grant it.
Data received from Google APIs is handled in accordance with the Google API Services User Data Policy, including its Limited Use requirements. See §3 of our Privacy Policy.
8. Fees
Where the Service is offered free of charge, we may introduce paid plans in the future. If we do, we will state the price and terms clearly before you are charged, and paid features will not be applied retroactively to usage that occurred while the Service was free. You are responsible for any charges you incur with third-party providers through your own credentials.
9. Availability, changes, and early-stage software
The Service is under active development and is provided on an "as available" basis. Features may change, break, or be removed. We may perform maintenance, impose limits, or modify the Service at any time. We will make reasonable efforts to avoid data loss, and we keep backups as described in the Privacy Policy, but you should keep your own copies of anything you cannot afford to lose.
10. Suspension and termination
You may stop using the Service and request deletion of your account at any time by emailing [email protected]. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if your use poses a risk to the Service or other users — with notice where reasonably possible. On termination, the licences granted in §5 end and your content is deleted as described in the Privacy Policy.
11. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory — including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, or that the Service will be uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, BIG NEWS LLC and its members, officers and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to the Service — even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or (b) fifty United States dollars (US$50).
Nothing in these Terms limits liability that cannot be limited under applicable law, including for fraud, or for death or personal injury caused by negligence.
13. Indemnity
You agree to indemnify and hold harmless BIG NEWS LLC from any claim, demand, loss or expense (including reasonable legal fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of the rights of a third party — including any third-party service you connect to Alphie.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising out of these Terms, and you consent to their jurisdiction and venue — except that either party may seek injunctive relief in any court of competent jurisdiction. If you are a consumer resident in a jurisdiction whose law grants you the right to bring proceedings in your local courts, this clause does not deprive you of that right.
15. Changes to these Terms
We may update these Terms as the Service changes. The "last updated" date above reflects the current version. For material changes we will notify you in the application before they take effect; continuing to use the Service after that constitutes acceptance.
16. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
